General Terms and Conditions

1. Scope
These Terms and Conditions, in the version valid at the time of the order, apply to all orders placed through our online shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is a natural or legal person acting in the exercise of their trade, business or profession when entering into the legal transaction.

2. Contracting party, conclusion of contract
The purchase contract is concluded with Fabian Kempert, Malteserstraße 13, 79423 Heitersheim, Germany, VAT ID DE328113931. By listing the products in the online shop we make a binding offer to conclude a contract for those items. You may place our products in the shopping basket without obligation and correct your entries at any time before submitting your binding order. The contract is concluded when you accept the offer for the goods in your basket by clicking the order button.

3. Contract language, storage of the contract text
The languages available for concluding the contract are German, English, French and Spanish. In the event of any discrepancy between the German version of these Terms and Conditions and any translation, the German version prevails. We store the contract text and send you the order details and our Terms and Conditions in text form.

4. Delivery, delivery area
Shipping costs are charged in addition to the stated product prices. Details of shipping costs are given with the individual offers. We deliver to Germany, to the countries of the European Union and to selected further countries. The list of countries selectable during checkout is decisive; delivery to countries not listed there is excluded. Collection in person is not possible.

5. Prices and payment
All prices are final prices and, for deliveries to consumers within the European Union, include the applicable statutory VAT. For deliveries to countries outside the European Union, additional customs duties, import taxes and fees may apply and are to be borne by the customer. The available payment methods are shown during checkout. The purchase price falls due on conclusion of the contract unless expressly agreed otherwise.

6. Retention of title
The goods remain our property until payment has been made in full. In relation to traders, we retain title to the goods until all claims arising from the ongoing business relationship have been settled in full.

7. Liability for defects (statutory warranty)
The statutory rules on liability for defects apply. For consumers, the limitation period for claims in respect of defects in newly manufactured goods is two years from receipt of the goods. For traders it is one year from the passing of risk. An additional manufacturer's guarantee exists only where expressly stated in the relevant product description; statutory rights in respect of defects remain unaffected and are not restricted by any manufacturer's guarantee.

8. Right of withdrawal
Consumers have a statutory right of withdrawal. Details and the model withdrawal form can be found in our withdrawal policy.

9. Export controls and sanctions
The goods we supply are subject to the export control and sanctions rules of the European Union and, where applicable, of other jurisdictions. The customer undertakes not to resell, export, re-export or otherwise make available the goods supplied, whether directly or indirectly, to any person, organisation or territory subject to sanctions of the European Union, the United Nations, the United Kingdom or the United States of America. This applies in particular to Belarus, Iran, Cuba, North Korea, Russia, Sudan and Syria, and to the territories of Ukraine currently occupied by Russia. The customer further undertakes to bind any subsequent purchasers to equivalent restrictions and to actively prevent any onward transfer in breach of these provisions. In the event of a breach we are entitled to withdraw from the contract; the customer shall indemnify us against any third-party claims arising from such a breach.

10. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
